DarvaAI provides:
AI-powered voice receptionist for restaurant reservations
Restaurant management dashboard
Reservation and customer database management
Automated SMS confirmation and reminder services
Analytics and reporting tools
3. Account Registration
To use our Services, you must:
Provide accurate and complete registration information
Maintain the security of your account credentials
Be at least 18 years old or have legal authority to enter into this agreement
Notify us immediately of any unauthorized access to your account
You are responsible for all activities that occur under your account.
Respond to customer-initiated SMS inquiries via AI-powered restaurant assistants. Phone numbers of customers who text a DarvaAI-powered restaurant are used solely to reply to their inquiry and are not shared with third parties for marketing purposes.
4. Acceptable Use
You agree not to:
Use the Services for any unlawful purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Services
Upload malicious code or content
Impersonate any person or entity
Collect data about other users without consent
Use the Services to send spam or unsolicited messages
Reverse engineer or attempt to extract source code
5. Restaurant Data and Content
You retain ownership of all data you submit to our platform. By using our Services, you grant us a license to:
Store and process your data to provide the Services
Use aggregated, anonymized data to improve our AI and Services
Display your restaurant information as necessary for reservation functions
You are responsible for ensuring you have the right to submit all data and that it complies with applicable laws.
6. AI Voice Agent
Our AI voice receptionist:
Handles reservation calls on behalf of your restaurant
May be recorded for quality assurance and training purposes
Operates according to your configured settings and availability
May occasionally make errors; you are responsible for verifying reservations
You agree to inform callers that they may be speaking with an AI assistant when required by local regulations.
7. SMS/Text Messaging Services
DarvaAI-powered restaurants may offer SMS-based communication through designated business phone numbers. By sending a
text message to a DarvaAI-powered phone number, you consent to receive automated text replies related to that
restaurant's services, including menu availability, operating hours, location information, reservation confirmations,
and reminders.
Messages are sent in response to customer-initiated inquiries. No marketing or promotional messages are sent.
Message frequency varies based on your interaction.
Message and data rates may apply.
Reply STOP to any message to opt out of further texts.
Reply HELP for assistance.
Carriers are not liable for delayed or undelivered messages.
8. Subscription and Payment
If applicable to your plan:
Subscription fees are billed in advance on a recurring basis
You authorize us to charge your payment method for all fees
Prices may change with 30 days' notice
Refunds are provided in accordance with our refund policy
Failure to pay may result in suspension of Services
9. Intellectual Property
DarvaAI and its licensors own all rights to the Services, including software, designs, trademarks, and content. You may not copy, modify, distribute, or create derivative works without our written permission.
10. Third-Party Services
Our Services integrate with third-party providers (e.g., telephony services, messaging APIs). Your use of these integrations is subject to the respective third-party terms. We are not responsible for third-party services or content.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICES AT YOUR OWN RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARVAAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless DarvaAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.
14. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your access if you violate these Terms. Upon termination:
Your right to use the Services will immediately cease
You may request export of your data within 30 days
We may delete your data after the retention period
Provisions that should survive termination will remain in effect
15. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Services. Continued use after changes constitutes acceptance of the modified Terms.
16. Governing Law
